The Vita hit the U.S. and European market last week after launching in Japan in the middle of December 2011. Sony announced in early January at CES that only 500k Vitas sold in its home market. Many pundits and outlet stated the Vita was dead on arrival, citing casual gaming on smartphones and tablets as the killer. But don't count the Vita out yet. It's alive and kicking.

A real estate contract is a contract for the purchase/sale, exchange, or other conveyance of real estate between parties. Real estate called leasehold estate is actually a rental of real property such as an apartment, and leases (rental contracts) cover such rentals since they typically do not result in recordable deeds. In many countries, real estate contracts must be in writing to be enforceable. In the United States the Statute of Frauds require real estate contracts to be in writing to be enforceable. In South Africa, the Alienation of Land Act specifies that any agreement of sale of immovable property must be in writing.

Additionally, a real estate contract must:

  • Identify the parties: The full name of the parties must be on the contract. In a sales contract, the parties are the seller(s) and buyer(s) of the real estate, who are often called the principals to distinguish them from real estate agents, who are effectively their intermediaries and representatives in negotiation of the price. If there are any real estate agents brokering the sale, they are typically listed also as the real estate brokers/agents who would earn the commission from the sale.
  • Identify the real estate (property): At least the address, but preferably the legal description must be on the contract.
  • Identify the purchase price: The amount of the sales price or a reasonably ascertainable figure (an appraisal to be completed at a future date) must be on the contract.
  • Include signatures: A real estate contract must be entered into voluntarily (not by force), and must be signed by the parties, to be enforceable.
  • Have a legal purpose: The contract is void if it calls for illegal action.
  • Involve Competent parties: Mentally impaired, drugged persons, etc. cannot enter into a contract. Contracts in which at least one of the parties is a minor are voidable by the minor.
  • Reflect a meeting of the minds: Each side must be clear and agree as to the essential details, rights, and obligations of the contract.
  • Include Consideration: Consideration is something of value bargained for in exchange of the real estate. Money is the most common form of consideration, but other consideration of value, such as other property in exchange, or a promise to perform (i.e. a promise to pay) is also satisfactory.

Notarization by a notary public is normally not required for a real estate contract, but many recording offices require that a seller?s or conveyor?s signature on a deed be notarized to record the deed. The real estate contract is typically not recorded with the government, although statements or declarations of the price paid are commonly required to be submitted to the recorder?s office.

Sometimes real estate contracts will provide for a lawyer review period of several days after the signing by the parties to check the provisions of the contract and counterpropose any that are unsuitable.

If there are any real estate brokers/agents brokering the sale, the buyer?s agent will often fill in the blanks on a standard contract form for the buyer(s) and seller(s) to sign. The broker commonly gets such contract forms from a real estate association he/she belongs to. When both buyer and seller have agreed to the contract by signing it, the broker provides copies of the signed contract to the buyer and seller.

As may be the case with other contracts, real estate contracts may be formed by one party making an offer and another party accepting the offer. To be enforceable, the offers and acceptances must be in writing (Statute of Frauds, Common Law)and signed by the parties agreeing to the contract. As with all other types of legal offers, the other party may accept the offer, reject it ? in which case the offer is terminated, make a counteroffer ? in which case the original offer is terminated, or not respond to the offer ? in which case the offer terminates by the expiration date in it. Before the offer (or counteroffer) is accepted, the offering (or countering) party can withdraw it. A counteroffer may be countered with yet another offer, and a counteroffering process may go on indefinitely between the parties.

To be enforceable, a real estate contract must possess original signatures by the parties and any alterations to the contract must be initialed by all the parties involved. If the original offer is marked up and initialed by the party receiving it, then signed, this is not an offer and acceptance but a counter-offer.

A real estate contract typically does not convey or transfer ownership of real estate by itself. A different document called a deed is used to convey real estate. In a real estate contract, the type of deed to be used to convey the real estate may be specified, such as a warranty deed or a quitclaim deed. If a deed type is not specifically mentioned, ?marketable title? may be specified, implying a warranty deed should be provided. Lenders will insist on a warranty deed. Any liens or other encumbrances on the title to the real estate should be mentioned up front in the real estate contract, so the presence of these deficiencies would not be a reason for voiding the contract at or before the closing. If the liens are not cleared before by the time of the closing, then the deed should specifically have an exception(s) listed for the lien(s) not cleared.

The buyer(s) signing the real estate contract are liable (legally responsible) for providing the promised consideration for the real estate, which is typically money in the amount of the purchase price. However, the details about the type of ownership may not be specified in the contract. Sometimes, signing buyer(s) may direct a lawyer preparing the deed separately what type of ownership to list on the deed and may decide to add a joint owner(s), such as a spouse, to the deed. For example, types of joint ownership (title) may include tenancy in common, joint tenancy with right of survivorship, or joint tenancy by the entireties. Another possibility is ownership in trust instead of direct ownership.

Some types of contingencies which can appear in a real estate contract include:

  • Mortgage contingency ? Performance of the contract (purchase of the real estate) is contingent upon or subject to the buyer getting a mortgage loan for the purchase. Usually such a contingency calls for a buyer to apply for a loan within a certain period of time after the contract is signed. Since most people who buy a house require financing to complete their purchase, mortgage contingencies are one of the most common type of contingencies in real property contracts. If the financing is not secured, the buyer may unilaterally cancel the contract by stating that his or her condition has not or will not be satisfied or allow the contract to expire by declining to waive the condition within the specified time period.
  • Inspection contingency ? Another buyer?s condition. Purchase of the real estate is contingent upon a satisfactory inspection of the real property revealing no significant defects. Contingencies could also be made on the satisfactory repair of a certain item associated with the real estate.

The seller retains the right to sell the property to another party if he so chooses after giving the buyer 72 hours notice to remove their contingency. The buyer will then either remove their contingency and provide proof that they can consummate the sale or will release the seller from their contract and allow the seller to move forward with the new contract.

A typical real estate contract specifies a date by which the closing must occur. The closing is the event in which the money (or other consideration) for the real estate is paid for and title (ownership) of the real estate is conveyed from the seller(s) to the buyer(s). The conveyance is done by the seller(s) signing a deed for buyer(s) or their attorneys or other agents to record the transfer of ownership. Often other paperwork is necessary at the closing.

The date of the closing is normally also the date when possession of the real estate is transferred from the seller(s) to the buyer(s). Transfer of possession of a house, condominium, or building is usually accomplished by handing over the key(s) to it. For example, the contract may say that the property is sold as is, especially if demolition is intended. Hello everyone! :) I'm gonna keep this pretty simple; I'm looking to start a roleplay or two that doesn't require too much effort but still has a good story to it. I'm trying to keep up a balance between writing and getting outside into actual life haha, so lately I've been posting once or twice a day in my RP's. On days I'm at home I can post repeatedly, but there will be occasional days where I don't post at all. So yeah! Basically I'm just looking for something that's not too demanding but still fun. :)

?Trust deeds are mortgages against pieces of real estate,? Jordan told me. ?These can be first, second, or third mortgages. Those we deal with are mostly for business purposes.?

Basically, someone looking to purchase a piece of investment property, or someone who wants to buy real estate for a business, turns to private financing instead of a bank. ?Borrowers use them to finance a business or investment property, rather than jumping through hoops at a bank. Investors lend the money to the borrower, and reap the return,? Jordan explained.

Trust deeds provide a way for individuals to fund a loan note, helping to fund specific properties that they think will do well.??While it?s possible to invest in residential trust deeds, I don?t encourage it,? he continued. ?The potential returns just aren?t as high, and when a homeowner defaults, the foreclosure process is onerous.? Jordan pointed out that if there is a default on an investment property, it can be taken over by the investor and serve as a source of revenue.

Reducing Risk When Investing in Trust Deeds

Part of the reason that Jordan is so enthusiastic about trust deeds is that it is possible to reduce the risk involved from foreclosure. ?Right now, there are a lot of discounted properties out there, and we only do deals to finance about 50% of the loan. If you do 50% of a $200,000 property, investing $100,000, even if there is a default, you can still sell for more than you paid for it.?

Jordan offered the example of a group of his clients that went in together to invest $1 million on a Section 8 rental property appraised at $2 million. When the borrower defaulted, the three clients took over ownership. Because the property is Section 8 housing, the rent is going to keep coming in. They can take their time selling, and in the meantime see regular income from the property.

Jordan also put together a trust deed fund for investors who might not be able to do huge deals. ?You can write a check into the fund, and finance several notes at once. As long as loan-to-value ratios are so low, the risk is limited ? and I do a lot of due diligence to choose properties for the fund.?

It is also possible for clients to pay 1% or 2% to insure against losses on the fun. ?I?m looking at Lloyd?s of London for insurance. The idea is to make sure that clients don?t lose a lot.?

Right now, insisted Jordan, trust deeds are a good deal. He acknowledged that they might not be such a good deal as the real estate market recovers, though. And, of course, there is always the risk of loss. ?Before the crash, some were investing in trust deeds with a loan-to-value of 90%,? Jordan said. ?That just wasn?t sustainable. By focusing on 50%, we?re hoping to limit a lot of the risks.?

OK ? so there are lots of ?G? words, however for today we?ll focus on one particular word that has created (I would have used the word ?wreaked?, but I personally think it?s a silly word that always seems to have an umbilical connection to the word ?havoc?) a bunch of havoc and confusion in our lives ? and has been responsible for severely damping our ability to really enjoy life.? The word?

?

GUILT!

?

Here?s Gene?s definition?Guilt:? Our personal ability to feel badly about something that did or did not happen ? and to punish ourselves accordingly for the dastardly deed(s).? We are cads, inconsiderate slobs, unthinking bastards, inattentive morons, uncaring imbeciles to be forever damned to a self-imposed sentence of remorse and mental anguish!? If that won?t take the fun out of a hog-calling contest, I don?t know what will.

?

So where?s all this guilt coming from?? Maybe Mom?? She?s always been an expert at laying the guilt trip on us.? How about our spouse or significant other?? Oh man, forget one little ol? anniversary and we?re toast forever.? Maybe from our children?? ?We never played catch in the back yard and that?s why I took drugs and went to prison!??? ?You always liked Petey best!?? ?You kicked me out of the house when I was only 37 and because of that, I can never buy a new car!?? Or maybe we managed to do something really stupid that got ourselves ? and other people in a heap of trouble.

?

What?s the common thread in all of these situations ? and in every other guilt-related event that we could ever think of?? These incidents all happened in the past!? OK ? maybe that?s not much of a revelation, but it?s the primary factor in our feelings (anguish, remorse, etc.) that we keep ignoring.? The past is gone, done, history, bye-bye, hasta luego, and kaput!? Unfortunately, we have a tendency to exert entirely too much effort dragging an event from the past back into our wee little brains where we can examine it under a microscope to reinforce once again, how absolutely dumb and unthoughtful we?ve been.? Sometimes we?ll even go to the trouble to contemplate a future situation and decide on a course of action based on how guilty we may or may not feel depending on our actions.? Eeeeewwww!

From here, it looks like we need to take care of a couple of things.? First, we need to get rid of all the guilt garbage that?s piled up in our heads.? And second, we need to keep from throwing any more garbage on the pile.? Hmmm, only two things.? We can handle that.

?

I?m pretty sure that at this point, we all honestly know where our guilt is coming from.? Yep ? from right inside our devious little minds.? It?s all a personal response to a given situation.? A response that depends almost entirely on our past experiences ? our mental/emotional programming.? So let?s take a look at our guilt generator to see if there are at least a couple of switches we can flip.

?

First ? the past.? We can?t change it so we?ll just have to deal with it ? either by taking action to rectify a situation (if appropriate) or by changing the way we?re thinking about it.? Sometimes, we really do need to do something.? If we?ve called our best friend a butt-head and are now feeling guilty about it, we probably need to re-establish contact and make our apologies.? What he or she then does with that apology is up to him/her, but at least we will have made a good effort to do the right thing.? If our past actions have caused major, major problems for someone, we may need to put extra, extra effort into our attempts to rectify the situation.

?

The main thing here is doing something to make things better.

?

One word (OK ? more than one) of caution.? We probably shouldn?t be doing ?things? to make amends for our perceived transgressions strictly in an attempt to make others think better of us. It ain?t agonna work.? Even though we may desperately want other people to have a good opinion of us, what they think is completely beyond our control.? Yes, we can influence the opinions of others, but we can never control it. ?And ? it really is a waste of effort and emotion to even try.? Too often, I think we may work for these approvals to try to reinforce or even build up our own feelings of self-worth.? Pats on the back are nice and approval is good, however they are meaningful only when they are given spontaneously.? Picture yourself trying really hard and doing everything you can possibly think of to snag some praise from a close friend.? Picture yourself not getting one smidgeon of acclaim.? Picture yourself getting royally ticked off at the stupidity of your friend.? It can be a vicious, demoralizing cycle.

?

Doing ?things? to rectify misunderstandings or hardships we may have imposed upon someone is logical and will likely be beneficial to everyone ? ourselves included.? And, once we?ve done what we think we need to do, we need to let it go!? We have done all that we can do and no matter what the outcome is, it?s over.? Let?s get on with life.

?

If we?re feeling guilty about something that happened that we have no way of ever doing anything to repair the situation, all we can do is let it go.? Remember, the past is the past ? and it?s gone forever.? All we can do is admit that we screwed up (if we really did), learn whatever it is we need to learn from our mistake and press on.? We?ll just try to do better from now on.? Maybe we?ve already been doing better.? Looks like good progress to me!

?

Now the future.? Guilt very often, is the result of our granting others permission to control our thoughts, feelings and perhaps even our actions.? No one can control us in any way without our consent.? Folks, we have enough trouble controlling our own thoughts and emotions.? It just doesn?t make sense to grant anyone else the privilege of doing that.? Flip the guilt consent switch to the off position.? If this is a drastic change from your usual approach, you can about bet that sooner or later, somebody is going to be very unhappy.? That?s the chance we take.? Of course, other folks have a right to feel any way they want about anything, don?t they?? It?s beyond our control.

?

Guilt can be good in that it can give us an incentive to do things better.? It can on the other hand, be really oppressive and can severely limit our ability to enjoy life and do those things we really want to do.? All we can do is the best we can do.? If we screw something up ? and we will ? we can learn from it and then do even better.? Life?s like that.? Cool!

?

Understanding Breast Cancer Responsiveness

What I did before

When I started treating breast cancer, systemic therapy recommendations were usually based only on the menopausal status of the woman and whether there was cancer in the axillary nodes.? Although estrogen status was being measured the importance of this marker was not appreciated.

What changed my practice

In the last decade there has been an explosion of information about the genetics and molecular makeup of breast cancers with a heightened understanding that breast cancer is not one disease. A landmark publication in 2000 described four types of breast cancer. 1 In a recent as yet unpublished study using newer sequencing technology, researchers at the BC Cancer Agency and collaborators from the UK have suggested 9 distinctive types of the disease. 2 ?The recognition of these subtypes of breast cancer is changing how we approach and treat the disease.

The risk of recurrence is a major concern when an early breast cancer is diagnosed as even with excellent surgery there is a risk of both local and systemic recurrence.? Architectural factors such as the size of the tumour and nodal involvement have classically been used to determine risk. Biological features such as estrogen receptor status, HER2 expression and grade, often measured by Ki67, are now being included in our risk assessment.

The responsiveness of the tumour has also become an important determinant in how we treat the disease.? Responsiveness describes how the tumour will be affected by specific treatments.?? For example, estrogen receptor status determines whether a breast cancer will respond to endocrine therapy; the gene HER2 is associated with response to anti HER2 therapy such as trastuzumab (Herceptin); and high KI67 tumours may be more responsive to chemotherapy than those with a lower grade or KI67.? Thus two similar sized tumours may get different treatment recommendations based on their biology.

What I do now

For patients with low grade estrogen receptor positive tumours I am recommending much less chemotherapy even if there is nodal involvement and/or the woman is premenopausal.? In these tumours, endocrine therapy may be the most effective treatment and chemotherapy may minimally impact survival.? Having said that, some patients still benefit from including chemotherapy in addition to hormone therapy.? For patients with HER2 overexpressing tumours I often recommend chemotherapy and trastuzumab even if the tumour is small with no involved nodes.? Understanding the biology of breast cancers is providing more personalized recommendations and this is translating into better outcomes.

As we further define subtypes, more targeted treatments will be developed but at this time for many cancers we continue to give broad cytotoxic therapy.? As well, new agents are being developed and may be further decrease recurrences. We are also now frequently rebiopsying recurrent cancers to further understand the markers of response and resistance and to tailor treatment. We also need to study the ?host? patient, as the pharmacogenomics of the individual may affect how the drug is metabolized and also may contribute to the effectiveness and the toxicity of the therapy.

How does this affect family physicians?? Treatment recommendations may be more complicated so counseling patients prior to their oncological consultation may be more confusing.? It may be more difficult to know whether chemotherapy will be recommended or not especially if we begin to do more complex assessments of tumours in specialized laboratories. Numerous studies are reported in the lay and academic press and are never substantiated.? Understanding what is of relevance to the care and management of our patients and which data is transient is difficult.? We need to ensure that the government prioritizes an upgrade of our electronic BC Cancer Agency website and electronic record to make it accessible to primary health care providers with the appropriate, evidence based results.

Biological information is often available as soon as the core biopsy diagnoses an invasive cancer.? Early referral to centres with multidisciplinary teams may avoid long delays and confusing information for both the patient and the primary care providers.? Electronic integrated systems may also aid the transfer of information. Frequent updates at family practice meetings and in journals can also provide current treatment and care models to a wider audience.? With this knowledge, family practices can provide a broad idea of the concept of adjuvant therapy for the treatment of early breast cancer and introduce the idea of chemotherapy, hormones and radiation without specifying the details.? Family doctors should be aware of the new patient package, including a patient book that is available through the Alliance for Breast Cancer Information at the BC Cancer Agency. 3 Reassuring patients about the improvements in survival as over 90% of early breast cancer cases in BC now live over 5 years will also help provide helpful information to decrease a woman?s anxiety. 4

Fifty years after Glenn flight, U.S. buying rides to space

CAPE CANAVERAL, Florida | Sun Feb 19, 2012 10:30am EST

CAPE CANAVERAL, Florida (Reuters) - Fifty years after John Glenn became the first American to orbit Earth, NASA no longer has the ability to fly astronauts in space, a decision Glenn lays squarely on the shoulders of the Bush administration.

Glenn's groundbreaking flight on February 20, 1962, put the United States into a heated space race with the Soviet Union, which had launched cosmonaut Yuri Gagarin into orbit 10 months earlier.

The retirement of the shuttles last year left the United States dependent on its former Cold War foe to get astronauts to and from the jointly owned International Space Station, which flies about 240 miles above the planet.

"I regret that that is the way things have developed," Glenn told a crowd of current and former NASA employees and guests at the Kennedy Space Center Visitor Complex on Saturday night, part of a series of celebrations marking the 50th anniversary of his flight.

"We spent over $100 billion dollars putting the space station up there. It's too bad in the previous administration the decision was made to end the shuttle, so now we have to go somewhere else to even get up to our station," said Glenn, who served as a Democratic senator from Ohio between 1975 to 1999.

The United States grounded its aging shuttles last year due to high operating costs and to free up funds for a new generation of spacecraft that can fly farther from Earth. More money would have been needed years earlier in order for the new ships to be ready by the time the old ones were retired.

Glenn parlayed his political connections into a long-awaited return to space in 1998 when, at age 77, he flew aboard the space shuttle Discovery as a research subject for experiments on aging sponsored by the National Institutes of Health.

Now 90, Glenn, a retired Marine Corps pilot, said research is the most important benefit of the U.S. space program and lauded the decision to extend the International Space Station's life to at least 2020 from 2015.

"People say, 'Well, what good is research?' I think every bit of progress made by human beings has been made because somebody was curious about the unknown," Glenn said.

"If there's one thing we have learned through the history of our country, it's that money spent on basic research has a way of paying back in the future beyond anything we ever see at the outset," he said.

MEDICAL MYSTERIES

Though research was not the reason Glenn and his Mercury Seven colleagues were launched into orbit, scientists had many questions about how the human body would manage in the weightless environment of space.

"The things we were looking at back on those first flights seem so primitive now, they're almost laughable," Glenn said. "The doctors were literally concerned that your eyes might change shape and your vision might change enough that you couldn't even see the instrument panel. We actually put a little miniaturized eye chart on the top of instrument panel.

Scott Carpenter, who followed Glenn into orbit three months later, said he swallowed radioactive food so doctors could see if his body could metabolize food in weightlessness.

"It was senseless, because you can eat food standing on your head and you process it very nicely. Why couldn't we do it the same way in zero gravity? Well, we had to prove it. I was given some radioactive food in a toothpaste tube and I was told to eat that on the first orbit. It was radioactive so they could trace its movement through my body," Carpenter said.

Two more Mercury missions followed Glenn and Carpenter's three-orbit flights, paving the way for the Gemini program and finally the real goal of the nascent human space program - sending a crew to the Moon.

"Although we were behind the Soviet Union, we were able to overtake them and do exactly what (President John F.) Kennedy told us to do," Glenn said. "In so doing we would beat the Russians to the Moon."

OLD FOE, NEW FRIEND

Now it is Russia that flies Americans into space aboard its Soyuz spacecraft, a service that costs NASA more than $300 million a year. The U.S. space agency also is spending about $3 billion a year to develop a capsule and rocket that can carry astronauts to the Moon, asteroids, Mars and other destinations beyond the space station. The first manned test flight is expected in 2021.

Meanwhile, in hopes of breaking Russia's monopoly on station crew transportation, NASA has invested $365.5 million since 2010 in six companies working to develop commercial space taxis. The agency wants $830 million for the year beginning October 1 to keep work going at two or more firms.

"I hope that some of these efforts to re-create our own transportation system come through and don't have a lot of problems because until then we are dependent on the Russians to get us into space," Glenn told Reuters.

"If anything happens to the Soyuz, if it should have to be grounded for any particular reason, we have no way of getting into space. It would end our manned program until we can invent new ways to get up there," Glenn said.
