SAN FRANCISCO (AP) ? A former journalist who became the subject of a Hollywood movie after he was caught fabricating articles in the late 1990s is fighting to become a lawyer in California over the objections of a state bar committee.
Stephen Glass, whose ethical missteps at The New Republic and other magazines were recounted in the film "Shattered Glass" and an autobiographical novel, has challenged the bar committee's decision to deny him a license to practice law, the San Francisco Chronicle (http://bit.ly/sfh2je) reported Monday.
Glass attended law school at Georgetown University and passed California's bar exam in 2007. His application for an attorney's license was turned down by the state's Committee of Bar Examiners, which judged him morally unfit for his new profession.
But an independent state bar court ruled in Glass's favor in July and the California Supreme Court has since agreed to hear the committee's appeal. No date for oral arguments has been set.
The bar association's lawyers said in written filings that even though Glass' transgressions occurred when he was in his 20s, his attempts at atonement were inadequate and in some cases coincided with the publication of his novel. They faulted him for never compensating anyone who was hurt by his falsehoods.
Law and journalism "share common core values ? trust, candor, veracity, honor, respect for others," Rachel Grunberg, a lawyer for the State Bar of California, told the Chronicle. "He violated every one of them."
The bar court that overruled the committee in July was convinced, however, that Glass was genuinely repentant and had been rehabilitated. His appeal included character references from 22 witnesses, including two judges who had employed him, two psychiatrists, and Martin Peretz, who owned The New Republic when Glass' deception occurred.
In his own statement to the bar, Glass said he was "greatly ashamed and remorseful about my lying" but "forthright and candid about my years of misconduct."
Glass tried to become a lawyer in New York after he passed that state's bar exam in 2003, but withdrew his application when his request for moral character approval from the New York bar languished.
Now 39, Glass works as a law clerk at a Beverly Hills firm. His Los Angeles-based attorney Susan Margolis declined to comment Monday evening.

GRAPEVINE, Texas ? Police in a quiet Fort Worth suburb worked Monday to piece together a family history after a man dressed in a Santa Claus suit apparently shot six relatives and himself on Christmas.
Grapevine police spokesman Sgt. Robert Eberling said the shooter showed up in the costume shortly before gunfire erupted and that the family appeared to have been opening Christmas presents. Police responding to a 911 call found four females and three males dead. They also found two handguns.
"We think he was just inside there celebrating Christmas with the rest of them and decided for whatever reason that's how he's going to end things," Eberling told The Associated Press.
Investigators worked through Sunday night and into Monday morning, meticulously searching the apartment where the bodies were found, along with vehicles parked outside. Police said they believe the victims were related, though some were visiting and didn't live in the apartment.
Eberling said investigators were assembling a "family history," and that the apartment was leased to a woman and her two children, one age 15 and the other either 19 or 20. He would not give other specifics.
"We're getting a clearer picture, but we're not ready to go on the record with anything until we find out from the medical examiner absolute confirmation of identities and the manner of death," Eberling said.
Autopsies of the shooter and the victims were being done Monday by the Tarrant County medical examiner, but it would probably be Tuesday before their identities were released, he said.
Roger Metcalf, a spokesman for the medical examiner's office, said the victims have been tentatively identified, but the office couldn't confirm the names because the state driver's license fingerprint database wasn't available on the holiday.
"In addition, we need to locate next of kin before information can be released, and our investigators are working on that as well," Metcalf wrote in an email to the AP.
Late Sunday evening, police intently searched a sport utility vehicle parked outside the apartment. The vehicle is registered to a man who listed his residence as a home two miles away in the neighboring suburb of Colleyville.
Thomas Ehrlich, who lives near the home in Colleyville, told the AP he heard from neighbors that police went to the house Sunday. He said he believed the man and woman who once lived there were estranged.
Records show the couple had financial problems and that their home, most recently valued on the county tax rolls at $336,200, had been sold in 2010 at a foreclosure auction ? although it appeared the man was still living there.
"I actually saw him out doing yard work just last weekend," Ehrlich said.
Spa manager Leah Langford said she became concerned when the man's wife didn't show up for work Monday at the business where she had been employed for four years. Langford said she got no response when she called the woman's cell phone, nor could she learn anything when she went to the Colleyville home and the Grapevine apartment.
"For somebody who's always early to work and who never misses a day of work, we expected the worst," Langford said.
The shootings Sunday were the first homicides in Grapevine in more than a year and a half.
Police and firefighters rushed to the Lincoln Vineyards complex about 11:30 a.m. after receiving a 911 call in which no one was on the other end of the line. Because no one responded on the phone, police went into the apartment, located at the back of the complex. They found the seven, aged 15 to 60, dead.
Many of the nearby apartments are vacant, and police said no neighbors reported hearing anything on a quiet Christmas morning when many people were not around.

NEW YORK (AP) ? NBA fans seem more excited about basketball's return than bitter about the lockout based on television ratings for the league's delayed openers.
The five Christmas games Sunday attracted large audiences, with the Bulls-Lakers matchup drawing the third-highest preliminary rating for a regular-season game on ABC. The 6.5 overnight rating trailed only a 7.3 for last year's highly anticipated Heat-Lakers showdown and a 7.9 for another meeting between Miami and LA in 2004.
Chris Paul's Clippers debut in the nightcap against the Warriors earned a 2.3 overnight, up 77 percent over last year's Portland-Golden State telecast. It was ESPN's highest-rated Christmas prime-time game.
The earlier night game on ESPN ? Magic-Thunder ? drew a 1.9 overnight, up 36 percent from to last year's Denver-Oklahoma City matchup. The afternoon's finals rematch on ABC, the Heat's rout of the Mavericks, earned a 5.6 overnight, up 6 percent from Boston-Orlando last year.
The Celtics-Knicks game on TNT to open the day drew a 4.1 overnight. The early game on ESPN last year, Bulls-Knicks, had a 2.7 on ESPN.
Ratings represent the percentage of all homes with televisions tuned to a program. Overnight ratings measure the country's largest markets.

WASHINGTON ? Republican presidential hopeful Newt Gingrich failed to qualify for Virginia's Super Tuesday primary ballot, the latest setback for a candidate whose standing in polls has been slipping. Gingrich's campaign said he would pursue an aggressive write-in campaign, though state law prohibits write-ins on primary ballots.
The state party said early Saturday that Gingrich and Texas Gov. Rick Perry had failed to submit the required 10,000 signatures to appear on the March 6 ballot.
Failing to get on the ballot in Virginia, where Gingrich lives, underscores the difficulty first-time national candidates have in preparing for the long haul of a presidential campaign.
And it illustrates the advantage held by Mitt Romney, the former Massachusetts governor, who has essentially been running for president for five years. Romney's team, larger than those of most of his opponents, has paid close attention to filing requirements in each state. He will appear on the Virginia ballot along with Texas Rep. Ron Paul, who also has run a national campaign before.
Ironically, Gingrich had a slight lead over Romney in a Quinnipiac poll of Virginia Republicans released earlier in the week.
The former House speaker surged in popularity in early December and tried to use that momentum to make up for a stalled campaign organization. But his standing in polls has slipped in recent days amid a barrage of negative ads in Iowa, where the Jan. 3 caucuses begin the contest for the Republican presidential nomination.
Three other candidates ? Minnesota Rep. Michele Bachmann, former Pennsylvania Sen. Rick Santorum and former Utah Gov. Jon Huntsman ? did not submit signatures before Virginia's deadline of 5 p.m. Thursday.
Gingrich's campaign attacked Virginia's primary system on Saturday, saying that "only a failed system" would disqualify Gingrich and other candidates and vowing to run a write-in campaign.
"Voters deserve the right to vote for any top contender, especially leading candidates," Gingrich campaign director Michael Krull said in a statement. "We will work with the Republican Party of Virginia to pursue an aggressive write-in campaign to make sure that all the voters of Virginia are able to vote for the candidate of their choice."
However, according to state law, "No write-in shall be permitted on ballots in primary elections."
"Virginia code prohibits write-ins in primaries. He can't do it," said Carl Tobias, a law professor at University of Richmond.
Tobias said Gingrich may have had trouble meeting a requirement that he must submit 400 signatures from each of Virginia's 11 congressional districts.
Gingrich's campaign did not immediately respond to a request for comment. Gingrich had been concerned enough to deliver his signatures personally. Rushing Wednesday from New Hampshire, which holds its primary on Jan. 10, he had supporters sign petitions before entering a rally in Arlington, Va.
Virginia GOP spokesman Garren Shipley said in a statement that volunteers spent Friday validating signatures on petitions that Romney, Paul, Perry and Gingrich had submitted. "After verification, RPV has determined that Newt Gingrich did not submit required 10k signatures and has not qualified for the VA primary," the party announced early Saturday on its Twitter feed. Shipley did not respond to telephone calls Saturday seeking comment.
Forty-six delegates will be at stake in Virginia's Super Tuesday primary. That's a small fraction of the 1,144 delegates needed to win the nomination. But they could prove pivotal in a close race, especially for a candidate like Gingrich, who expects to do well in Southern contests.
Gingrich already missed the deadline to appear on the ballot in Missouri's Feb. 7 primary, though he insists it doesn't matter because the state awards delegates based not on the primary but on a Republican caucus held in March.
Meanwhile, Virginia's Democrats said President Barack Obama's re-election campaign gathered enough signatures to get him on the state's primary ballot though he was the only candidate who qualified.

Cleveland? Akron has hired Terry Bowden as its new football coach Thursday to turn around a woeful program.
Bowden, a one-time hot coaching commodity who spent six seasons at Auburn and the past three at Division II North Alabama, takes over a team than went 2-22 and won just one conference game the past two seasons.
"I'm so excited to be a Zip," said Bowden, who coached Akron's quarterbacks in 1986 under Gerry Faust. "With the great resources and the commitment to winning by the administration and community, it's just a matter of time until we build a championship program."
ESPN first reported Bowden's hiring.
The school will introduce Bowden at a news conference Dec. 28.
Bowden, the son of famed former Florida State coach Bobby Bowden, has been at North Alabama the past three seasons after a decade-long absence from the sidelines. He was once one of college football's hottest young coaches and won his first 20 games after taking over a probation-racked Auburn program. He left in midseason in 1998 after the Tigers started 1-5, maintaining ever since that he bolted only after being told by then-trustee Bobby Lowder that he would be fired.
During his time out of coaching, Bowden worked as a college football analyst for ABC and hosted a radio show in Orlando.
At Akron, he'll replace Rob Ianello, who went 1-15 in the Mid-American Conference and was fired in November.
"We welcome Terry Bowden back to campus. He brings with him an outstanding record of success and a true football coaching pedigree," school president Dr. Luis M. Proenza said. "We know the entire Akron community will support Coach Bowden in his mission to cultivate a championship program here."
Akron's program has lacked stability the past few years. The NCAA stripped the school of scholarships in 2008 for failing to comply with graduation rate policies. One of Bowden's first priorities will be making recruiting inroads in Northeast Ohio.
Before taking over at Auburn in 1992, Bowden built successful programs at Salem College (W.Va.) and Samford. When he took the job at Salem in 1983, he was just 26 ? the nation's youngest head coach.
Bowden led North Alabama to the Division II playoffs in all three seasons with a team stocked with transfers like ex-Florida cornerback Janoris Jenkins, former Florida State receiver Jarmon Fortson and onetime Georgia Southern starting quarterback Lee Chapple.
The Lions lost 42-17 to Delta State in the second round of the playoffs this season.
Bowden has a 140-62-2 record in 18 seasons as a coach.

KINSHASA, Congo ? Police fired tear gas Friday at supporters of Congo's opposition leader who had gathered near a stadium to see him inaugurating himself as president, three days after President Joseph Kabila was sworn in for a second term.
It was unclear if 79-year-old opposition leader Etienne Tshisekedi would make it to Kinshasa's Martyrs' Stadium for the unofficial act that observers fear could spark more election-related violence in the mineral-rich central African nation.
About 1,000 Tshisekedi supporters of gathered near the stadium Friday morning. Several tanks waited nearby.
Police thronged Tshisekedi's neighborhood, possibly to keep him from reaching the stadium.
Hours after the event was scheduled to begin, a spokesman for Tshisekedi's party said he was still at home and was consulting with colleagues on his next move.
"Etienne Tshisekedi is well at his home in Limete" neighborhood, said Jean Marie Vianey Kabukanyi.
Police inspector general Charles Bisengimana said the situation was calm in Kinshasa. He said he did not know if Tshisekedi would be able to go through with his plans.
"It's not for the police to permit someone to do such and such an act, but the work of the police to maintain public order," he said.
Tshisekedi earlier declared himself the winner of the November election that international and local observers say lacked credibility, defying Kabila who results said had 49 percent of the vote, compared to 32 percent for Tshisekedi.
Kabila came to power after his father's assassination and has led Congo for a decade. His father, Laurent Kabila, was a rebel leader who toppled the country's dictator of 32 years, Mobutu Sese Seko, in 1997.
Joseph Kabila was declared the winner following constitutional reforms he pushed through parliament limiting the election to one round. Under the old rules, any winner had to have more than 50 percent of votes.
Human Rights Watch said Wednesday that security forces have killed at least 24 people and detained dozens in attacks to quell dissent over the much-criticized vote.
Tshisekedi last month ordered his followers to stage jailbreaks to free detained colleagues.
Observers fear unrest if Tshisekedi, who is enormously popular with the country's impoverished masses, orders his supporters to take to the streets.
The November election was only the second democratic vote in Congo's 51-year history, and the first to be organized by the Congolese government rather than by the international community.
Congo, which is sub-Saharan Africa's largest country, has suffered decades of dictatorship and civil war. The country's east is still wracked by violence perpetrated by dozens of militia and rebel groups.

The three ?X Factor? finalists got two final chances to impress the voters on Wednesday night, once in a duet and once with their audition song. It was an odd choice on the part of the show?s organizers, making the finale a report card where the two categories boiled down to ?Plays Well with Others? and ?Most Improved.?
The duets were ... well, interesting would be one word. Random is another. Josh Krajcik and Alanis Morrissette? Really? How did that conversation go? ?Josh, great news! You get to sing with one of the most prominent female vocalists of the last two decades! But there?s a catch. You have to try to sing ?Uninvited.?
That didn?t go so well, especially since Krajcik?s facial expression never got beyond the ?Holy moly, I?m onstage with Alanis Morissette!? stage. Fortunately, he got a second chance, and ?At Last? drew raves, but it was ultimately the least memorable pair of numbers on the night. He was also the first to perform, which never helps in the voting.
Chris Rene went second, and again had the random pop star partner in Avril Lavigne. ?Complicated,? wasn?t much better than the previous duet, but Rene looked more comfortable and got his chance to take the spotlight with his riff towards the end of the number.
Rene also had a huge advantage in that his audition song became a YouTube sensation in about a nanosecond. Though we?ve all heard ?Young Homie? before, it was a reminder that of all the ?X Factor? finalists he?s the best equipped to have that hit single right away.
That left it up to Melanie Amaro. The judges all picked at her duet with R. Kelly and ?I Believe I Can Fly,? which continues the trend in which she gets nagged at for small things while the other contestants can skate by with pretty much anything. We did get some variety, though, as this time the culprit was ?wrong key? instead of ?predictable.?
But she got to close the show, and made Beyonce?s ?Listen? a song that will resonate in the minds of her fans. If this is based on pure vocal abilities, she?s a lock. But is that ever really the case?
To add to the drama, all three singers had cameras in their hometowns. Krajcik?s were at his old high school, a place he graduated before some of the current students were born. Rene?s were at a nightclub he performed at, and Amaro?s were at her church.
Of course, those selections were far from random. Krajcik, who came to his audition fresh off a job making burritos, is the everyman. Rene?s the club entertainer pulled back from the brink of self-destruction. Amaro defines herself by her faith, and it was Simon?s faith in her in bringing her back (or more likely his desire for some added drama, but why be cynical on such an important night?) that caused her to have the needed faith in her own abilities to become a favorite.
Which storyline will win? Well, as Simon Cowell said, this is likely to be the closest finale in the show?s history. Of course, it?s the first season, so that went without saying.
Krajcik is the longshot, so it?ll likely come down to the best voice against the best song. I?d bet on Amaro to win, but no result would be truly be surprising. And as long as a lot of folks watch and the winner goes onto become bigger than Kelly Clarkson, Carrie Underwood and Chris Daughtry combined, the ?X Factor? brass will be happy. No pressure.

Published at 12:15 p.m. ET: LONDON -- CNN star interviewer Piers Morgan refused Tuesday to disclose details about the most damning link between himself and Britain's phone hacking scandal: His acknowledgment that he once listened to a phone message left by former Beatle Paul McCartney for his then-wife Heather Mills.
In a 2006 article in the Daily Mail tabloid, Morgan said he was played a phone message left by the former Beatle on Mills' answering machine, describing it in detail and noting that McCartney "even sang 'We Can Work It Out' into the answerphone." Mills has said there's no way Morgan could have obtained the message honestly.
On Tuesday, Morgan stubbornly refused to answer almost any questions about how he came to hear the message, saying that doing so would compromise a source. "I'm not going to start any trail that leads to the identification of a source," he said.
Asked by inquiry chief Lord Justice Brian Leveson whether he could supply any information to back the assertion that he had heard the recording legally, Morgan said he couldn't.

LONDON -- Former News of the World editor and CNN interviewer Piers Morgan will appear by videolink from the United States on Tuesday at a judge-led investigation into the ethics and practices of Britain's scandal-tarred press.
He is expected to be grilled about comments he has made about widespread phone hacking at tabloid newspapers.
Media mogul Rupert Murdoch's News Corp shut down the News of the World in July after a public outcry over the phone-hacking practices by British journalists at the newspaper.
Morgan's appearance, along with a number of other witnesses Tuesday, has been widely anticipated and critics have been picking through old interviews and Morgan's autobiography "The Insider," in which the 46-year-old Morgan makes clear he knew of phone hacking as long ago as 2001.
In an interview for GQ magazine before the public scandal over the practice, Morgan said he couldn't get too upset over hacking because "loads of newspaper journalists were doing it."
And, in an earlier interview for BBC radio unearthed by one of his critics, Morgan appeared to go further, saying it was difficult to condemn private eyes hired to hack into people's phones "because obviously you were running the results of their work."

Former Daily Mirror and News of the World editor Piers Morgan and Rebekah Brooks (then Rebekah Wade), editor of the Sun newspaper, at the book launch party for Piers Morgan's memoirs, entitled "The Insider," on March 9, 2005 in London.
Morgan maintains that he has never participated in phone hacking or knowingly run a story based on an illegally intercepted message.
"I have never hacked a phone, told anyone to hack a phone, nor to my knowledge published any story obtained from the hacking of a phone," he said in a statement in August.
Actors Hugh Grant and Sienna Miller, "Harry Potter" author J.K. Rowling and singer Charlotte Church are among those who have given evidence about press abuse, while executives and lawyers for Murdoch's News Corp have defended the newspaper.
From newspaper man to TV star
Morgan shot to national prominence when he was picked by Murdoch to run the News of the World at age 28. Under his tenure, the tabloid exposed Grant's liaison with Hollywood prostitute Divine Brown and Princess Diana's late-night phone calls to married art dealer Oliver Hoare.
It wasn't all down to good reporting: Morgan has acknowledged that bribes were paid to informants on rival titles.
In 1995, Morgan left the News of the World for the Daily Mirror. His time there was marked by scoops and controversy, including an insider trading scandal.
Among the newspapers to report it was The Independent, which said he allegedly bought 20,000 pounds ($31,000) worth of shares in a technology company the day before it was tipped in the newspaper's investment column. While two other journalists at the Daily Mirror were jailed, Morgan was not charged and kept his job.
However, his editorship at the Daily Mirror ended in 2004 when he ran a faked photograph purporting to show a British soldier urinating on an Iraqi detainee.
Morgan won a second life as a TV personality, eventually signing on as a judge of "America's Got Talent" and taking Larry King's old spot at CNN. So far, he's prospered. Ratings for "Piers Morgan Tonight" have been up 9 percent on last year's figures ? good if not spectacular ? and he appears to be reaching a younger audience.
CNN spokeswoman Barbara Levin said the network was "extremely pleased" with how Morgan's program was performing and the company has so far stood by its star even as the phone-hacking scandal threatens to draw him in.
'Despicable human being'
"So heartwarming that everyone in U.K.'s missing me so much they want me to come home," Morgan joked earlier this year amid demands he return to give evidence to the Leveson Inquiry.
Morgan's denial that he has had nothing to do with phone hacking is hard to square with a 2006 article in which he said he'd been played a phone message that former Beatle Paul McCartney left for his now ex-wife Heather Mills in the wake of one of their fights.
"It was heartbreaking," Morgan wrote of the tape, saying that McCartney "sounded lonely, miserable and desperate, and even sang 'We Can Work It Out' into the answerphone."
How did Morgan come to hear the tape? He's refused to say, but Mills told the BBC in August that "there was absolutely no honest way" he could have obtained the recording. McCartney echoed her sentiment, saying he'd apparently been hacked.
Morgan's autobiography also abounds with tantalizing references to questionably obtained material: There's "a dodgy transcript of a phone conversation" and a celebrity's stolen laptop.
And when actress Kate Winslet demanded to know how Morgan got her cell phone number, which she had only just changed, Morgan shrugged it off.
"Look, Kate," he joked, "You don't get to be the editor of the Mirror without being a fairly despicable human being."

HARRISBURG, Pa. ? A judge says two Penn State officials can be tried on charges of lying to a grand jury in the university's child sex-abuse scandal.
District Judge William Wenner ruled Friday that prosecutors had probable cause to send the case against Tim Curley and Gary Schultz to trial.
Wenner heard testimony against Curley and Schultz on charges they lied to a grand jury and didn't properly report an allegation that former assistant football coach Jerry Sandusky sodomized a boy in a locker room shower in 2002.
Their lawyers maintain the men are innocent, and contest testimony that they were told about the seriousness of the matter.
Sandusky says he's innocent of more than 50 counts of child sex-abuse involving 10 boys over a span of 12 years.

A Penn State assistant football coach testified Friday that he believes he saw former assistant coach Jerry Sandusky molesting a boy on campus and that he fully conveyed what he had seen to two Penn State administrators.
Mike McQueary, speaking for the first time in public about the 2002 encounter in a Penn State locker room, said he believes that Sandusky was attacking the child with his hands around the boy's waist but said he wasn't 100 percent sure it was intercourse.
McQueary took the stand Friday morning in a Pennsylvania courtroom during a preliminary hearing for university officials Tim Curley and Gary Schultz, who are accused of lying to a grand jury about what McQueary told them.
District Judge William C. Wenner was hearing testimony Friday to help him decide whether prosecutors have enough evidence against the pair to send their cases to trial. The hearing was expected to last most of the day.
McQueary's story is central to the case against Curley and Schultz. They testified to the grand jury that McQueary never relayed the seriousness of what he saw. The officials, and Penn State coach Joe Paterno, have been criticized for never telling police about the 2002 allegation. Prosecutors say Sandusky continued to abuse boys for six more years.
The lawyers for Curley and Schultz say the men are innocent. Curley and Schultz told the grand jury that they remembered McQueary reporting only something inappropriate, like wrestling, but nothing as serious as rape.
Defense lawyers said a perjury charge should be based solely on a person's testimony under oath contradicting someone else's testimony. The defense said uncorroborated testimony from McQueary is not enough and sought to pick apart the ways he described the shower scene differently to different people.
The defense noted that McQueary admitted changing his description of the shower encounter when speaking with Paterno ? enough so that the coach didn't believe a crime had occurred.
McQueary, who was on the stand for about two hours Friday, said he had stopped by a campus football locker room to drop off a pair of sneakers in the spring of 2002 when he heard slapping sounds in a shower and happened upon Sandusky and the boy.
He said Sandusky was behind the boy he estimated to be 10 or 12 years old, with his hands wrapped around the boy's waist. He said the boy was facing a wall, with his hands on it.
McQueary, 37, said he has never described what he saw as anal rape or anal intercourse and couldn't see Sandusky's genitals, but that "it was very clear that it looked like there was intercourse going on."
In its report last month, the grand jury summarized McQueary's testimony as saying he "saw a naked boy ... with his hands up against the wall, being subjected to anal intercourse by a naked Sandusky."
Under cross examination by an attorney for Curley, McQueary reiterated that he had not seen Sandusky penetrating or fondling the boy but was nearly certain they were having intercourse because the two were standing so close and Sandusky's arms were wrapped around the youth.
He said he peeked into the shower three times ? the first via a mirror, the other two times directly. The last time he looked in, Sandusky and the boy had separated, he said. He said he didn't say anything, but "I know they saw me. They looked directly in my eye, both of them."
McQueary said the entire encounter ? from when he first entered the locker room to when he retreated to his office ? lasted about 45 seconds.
McQueary said he reported what he saw to Paterno but never went to police.
He said he did not give Paterno explicit details of what he believed he'd seen, saying he wouldn't have used terms like sodomy or anal intercourse out of respect for the longtime coach.
Paterno told the grand jury that McQueary reported seeing Sandusky doing something of a "sexual nature" with the youngster but that he didn't press for details.
"I didn't push Mike ... because he was very upset," Paterno said. "I knew Mike was upset, and I knew some kind of inappropriate action was being taken by Jerry Sandusky with a youngster."
McQueary said Paterno told him he'd "done the right thing" by reporting the encounter. The head coach appeared shocked and saddened and slumped back in his chair, McQueary said.
Paterno told McQueary he would talk to others about what he'd reported.
Nine or 10 days later, McQueary said he met with Curley and Schultz and told them he'd seen Sandusky and a boy, both naked, in the shower after hearing skin-on-skin slapping sounds.
"I told them that I saw Jerry in the showers with a young boy and that what I had seen was extremely sexual and over the lines and it was wrong," McQueary said. "I would have described that it was extremely sexual and I thought that some kind of intercourse was going on."
McQueary said he was left with the impression both men took his report seriously. When asked why he didn't go to police, he referenced Schultz's position as a vice president at the university who had overseen the campus police
"I thought I was talking to the head of the police, to be frank with you," he said. "In my mind it was like speaking to a (district attorney). It was someone who police reported to and would know what to do with it."
Curley told the grand jury that he couldn't recall his specific conversation with McQueary, but that McQueary never reported seeing anal intercourse or other sexual conduct. He said he recalled McQueary reporting wrestling or "horsing around."
Schultz said he remembered McQueary and Paterno describing what the younger coach saw only in a very general way.
"I had the impression it was inappropriate," Schultz told the grand jury. "I had the feeling it was some king of wrestling activity and maybe Jerry might have grabbed a young boys genitals."
Under cross-examination, McQueary said he considered what he saw a crime but didn't call police because "it was delicate in nature."
"I tried to use my best judgment," he said. "I was sure the act was over." He said he never tried to find the boy.
Paterno, Schultz and Curley didn't testify, but Judge Wenner read their grand jury testimony from January in weighing the case.
Sandusky says he is innocent of more than 50 charges stemming from what authorities say were sexual assaults over 12 years on 10 boys in his home, on Penn State property and elsewhere. The scandal has provoked strong criticism that Penn State officials didn't do enough to stop Sandusky, and prompted the departures of Paterno and the school's longtime president, Graham Spanier.
Curley, 57, Penn State's athletic director, was placed on leave by the university after his arrest. Schultz, 62, returned to retirement after spending about four decades at the school, most recently as senior vice president for business and finance, and treasurer.

Many small mammals avoid the problem by hibernating but this survival strategy is generally not practised by larger animals. With the exception of some bears, large mammals remain fully awake throughout the year, yet they too must reduce their metabolism to cope with the comparative scarcity of food. Red deer, for example, are known to lower their heart rate and to allow their extremities to cool substantially during winter. These changes have been interpreted as a mechanism for conserving energy but could simply reflect the fact that the animals cannot find enough food to eat, as the act of digestion is known to have a direct influence on a ruminant's metabolism.
It is clear that red deer must minimise their energy requirements to be able to survive on little but their own body fat over the long winter season. To understand how they do so, Christopher Turbill and colleagues at the University of Veterinary Medicine, Vienna inserted special transmitters into the reticulum (the foremost part of the stomach) of 15 female red deer and monitored the animals' heart rate and stomach temperature for a period of 18 months, including two winters. The deer lived under near-natural conditions but their food intake was tightly controlled, with the amount and the protein richness determined by the scientists. The air temperature was also recorded and statistical modeling was used to untangle the effects of the various different factors including swallowing snow, which naturally led to a rapid and dramatic decrease in stomach temperature on the animals' metabolism.
The slow season
The most striking result was that the deer lowered their heart rates in winter regardless of how much food they ate. A heart rate of 65-70 beats per minute in May declined gradually to about 40 beats per minute throughout the winter, even when the deer were supplied with plenty of protein-rich food. Heart rate is a good indicator of metabolic rate, so as Turbill says, "The decrease in metabolism occurred exactly when food is normally scarce although our animals always had enough to eat and this shows that the deer are somehow 'programmed' to conserve reserves during winter." The enormous rise in heart rate in spring, at the start of the breeding season, was not associated with any change in food availability so also forms part of the animals' internal programming. As expected, when the deer were offered less food, their heart rates dropped even further. Surprisingly, however, this effect could also be observed in summer and was not solely caused by the reduced amount of digestion, showing that red deer react both to the winter season and to food shortages by actively lowering their metabolism.
Turbill, Arnold and coworkers found that the lowered heart rate was associated with a reduction in stomach (core body) temperature, suggesting that the deer adjust energy expenditure by regulating their internal heat production. However, relatively small changes in stomach temperature had larger than expected effects on metabolic rate, implying that the animals have an additional mechanism for saving energy. The key to explaining the results came from previous studies in Arnold's group, which had shown that red deer can greatly lower the temperature of their legs and other extremities, especially during cold winter nights. It thus seems likely that a small reduction in stomach temperature indicates a much greater reduction in the temperature of the deer's entire body, which could explain the substantial reduction in heart rate and metabolism. "Perhaps larger animals are able to make use of their size to enable temperature gradients," Arnold proposes. "This would enable them to reduce their metabolism dramatically without requiring a big decrease in core body temperature. It seems as though peripheral cooling might be an important mechanism for red deer and maybe other large mammals to conserve energy during winter and when food is scarce."

On Christmas Day 2010, NASA's Swift satellite detected a massive, sustained gamma-ray burst whose cause still leaves astronomers baffled.
The Christmas sky last year was lit up by an extraordinarily powerful and mysteriously long-lasting explosion in space that scientists now suggest was a comet smacking into a dense star or a peculiar supernova death.
Skip to next paragraphRadiation from?gamma-ray bursts, the most powerful explosions ever seen in the universe, strikes Earth's atmosphere from random directions in space about twice a day. These bursts can be roughly divided into two kinds, ones lasting less than two seconds, and ones lasting up to minutes.
However, the strange gamma-ray burst?detected on Christmas Day 2010?by NASA's Swift satellite lasted at least half an hour.
Scientists think shorter gamma-ray bursts are generally caused by merging neutron stars ? dead stars made up of super-dense neutron matter. Longer bursts are typically thought to originate from hypernovas, in which giant stars that explode as incredibly?powerful supernovas?spew two opposing jets of energy as they die; we see them head-on as bursts. ?[Photos of Great Supernova Explosions]
However, researchers suspect a number of mysterious events of completely different origins could mimic gamma-ray bursts. Such might be the case with the Christmas burst, formally known as GRB 101225A.
"It is important to understand gamma-ray bursts to get some global picture of the life and death of massive stars," said astronomer Christina Th?ne of the Institute of Astrophysics in Andalusia, Spain. "Massive stars are ultimately the ones that decide what elements are present, created and recycled in the gas in our and any other galaxy."
Now scientists have two competing explanations for the Christmas burst: a cosmic impact on a dead star in our galaxy, or a peculiar supernova in a distant galaxy.
Based on the length and?brightness of the burst, astrophysicist Sergio Campana at the Astronomical Observatory of Brera in Italy and his colleagues suggest that a minor body such as a comet or asteroid crashed into a neutron star.
"I think this is the discovery of a completely new astrophysical phenomenon that has not been envisaged before," Campana told SPACE.com.
